Partner Visa (Subclass 309/100 and Subclass 820/801)
Live with Your Partner in Australia
Find out if you’re eligible for a Partner Visa and take the first step towards living with your partner in Australia.
The Partner Visa allows spouses and de facto partners of Australian citizens, permanent residents, or eligible New Zealand citizens to live in Australia. There are two types of partner visas: the Temporary Partner Visa (Subclass 820 or 309) and the Permanent Partner Visa (Subclass 801 or 100).
- Subclass 820/801: For applicants applying from within Australia.
- Subclass 309/100: For applicants applying from outside Australia.
The visa process typically begins with a temporary visa and, once the relationship continues, leads to permanent residency.

- You must provide evidence of your relationship, such as joint financial records, shared living arrangements, and social commitments.

Understanding the Partner Visa (Subclass 820/801 and 309/100)
The partner visa application is generally processed in two stages:
- Temporary Partner Visa (Subclass 820/309)
- This is the first stage in the visa process and allows you to live in Australia temporarily while your permanent visa is being processed.
- Eligibility: You must be married to or in a de facto relationship with an Australian citizen, permanent resident, or eligible New Zealand citizen.
- Duration: You can live in Australia until a decision is made on your permanent visa application (Subclass 801/100).
- Work and Study: You are allowed to work and study while holding this visa.
- Permanent Partner Visa (Subclass 801/100)
- Once your relationship continues for a further two years after your temporary visa is granted, you may be eligible for permanent residency.
- Eligibility: Your relationship must still be genuine and ongoing.
- Duration: This visa grants you permanent residency in Australia.
Benefits: Permanent residency gives you full work rights, access to Medicare, and the option to apply for Australian citizenship.
